New California Rules of Professional Conduct

On November 1, 2018, the state changed the numbering on every Rule of Professional Conduct, added new rules and modified the standards applicable to some of the most important rules governing  small or sole firm practice.

Our panel of experts will discuss tips and best practices for complying with the following select new rules:

  • Heightened standard for the diligent prosecution of matters
  • New standards for maintaining advanced fees in a client trust account, including new definitions for true retainers, flat fees and advanced fees
  • New duties:
    • to inform a court or tribunal about any directly adverse authorities
    • of truthfulness in statements made to others, including adverse parties
    • related to communications with unrepresented parties
    • for managerial or supervisory lawyers
  • New liability for failing to communicate with clients even if there is no resulting damage
  • New stand-alone, single-page mediation disclosure and written consent obligation (EC 1129)
