For Whom the Whistle Blows: Recent Developments in Labor Code sec. 1102.5 This program will discuss the various sections of the statute, and address certain questions which may arise.

Presented by: Labor and Employment Law Section

Hosted by:JAMS Arbitration, Mediation, and ADR Services

Labor Code sec. 1102.5 provides a right of action for employees who report improper conduct, either to a government agency or to the employer. This program will discuss the various sections of the statute, and address certain questions which may arise.  For example, what if an employee reports misconduct (such as overcharging customers) to a company executive who already knows about the claim? What if the employee reports the conduct to the very executive who is being accused of such conduct? Does the employee need to demonstrate a good faith belief in the acts he is reporting? These and other issues will be discussed, as will recent case law.
