After a year of advising clients on remote working, stay-at-home orders, and reductions in workforces, the tides have turned and employment law attorneys, plaintiff and defense-side alike, now are busy advising their clients on potential legal claims and what to expect in this next wave of navigating the COVID-19 pandemic. At the top of the list is determining the rights of employees and the obligations of employers when it comes to returning employees to work, requiring employees to take the COVID-19 vaccination in order to return to work, disability claims, and reasonable accommodation requests. Joined by both plaintiff’s and management-side attorneys, along with two employment mediators, this lively one-hour discussion will provide insights on these topics and what to anticipate in terms of potential litigation claims in 2021 and beyond, and how to best navigate these claims both in litigation and mediation.
