Ethical Issues that arise from Concurrent Representation of Multiple Clients
Program Description:
This program will include a discussion on:
1) The differences between the new Rule of Professional Conduct 1.7 (Conflict of Interest: Current Clients), and the old rules which they replace, Rules of Professional Conduct 3-310 (B), (C) & (E) (Avoiding the Representation of Adverse Interests), effective on November 1, 2018, as approved by the Supreme Court on May 10, 2018. 
2) The application of the new rule to trust and probate matters.
3) The recent California Supreme Court decision in Sheppard, Mullin, Richter & Hampton LLP v. J-M Manufacturing Co., Inc., S232946 (Aug. 30, 2018) which involved the violation of Rule of Professional Conduct 3-310(C), avoiding the representation of adverse interests, the validity of advance waivers of conflict, the invalidity of an agreement to arbitrate fee disputes, and the new test for quantum meruit recovery.
