Program Description:
California has enacted a series of prompt payment statutes that are designed to insure the prompt release of progress payments and retention payments to downstream contractors by threatening potentially harsh monetary penalties for certain violations of the statutory scheme.  The Supreme Court in United Riggers & Erectors, Inc. v. Coast Iron & Steel Co. recently resolved a split in authority on the interpretation of Civil Code section 8814, concluding that a good faith dispute as to change orders was not sufficient to delay payment of project retention.  This program will provide a brief overview of California’s prompt payment statutes and highlight some of the key cases interpreting those statutes.
