Full Title:I Need Some Sort Of “Excuse Rolodex…” A Review of Motions to Reopen In Absentia Orders
What is the best strategy when an in absentia order of
deportation or removal stands in the way of your client applying for permanent
residency, or places them at risk of separation from their home and family?
Does it matter how long ago they were ordered deported or removed, what
paperwork they received, or why they did not appear for court? What are the
legal standards and deadlines for filing? And when should you file a motion
with the Immigration Court or BIA as opposed to requesting a joint motion with
DHS? This program will provide a comprehensive review of the legal standards
for reopening in absentia orders, address recent legal updates, and discuss
strategy considerations when seeking to reopen.
