Brand recognition and reach is key for cannabis stakeholders fighting to become household names in the nascent regulated market. Those rolling out cannabis advertising and marketing campaigns, and the platforms that host them, must navigate state and local cannabis marketing and advertising rules, while accounting for risk posed by continued federal prohibition. In this program, attorneys from LACBA’s Cannabis Law Section and in-house counsel from Outfront Media will discuss evolving legal issues in the exciting, heavily-regulated (and increasingly-litigated) cannabis advertising space. We will cover recent California litigation regarding billboard advertising and the future of cannabis advertising in outdoor spaces, as well as considerations and best practices when advising online advertising platforms or cannabis clients utilizing the digital advertising space. We will explore other legal issues that intersect with cannabis marketing and advertising, such as Section 230 of the Communications Decency Act and the First Amendment. Panelists will also discuss related litigation trends.
