Everyone brings implicit biases to a trial. To minimize the negative effects of these biases, attorneys and their clients should identify and manage their implicit biases, as well as those of opposing counsel and jurors. This two-part series takes a 360-degree look at how implicit biases impact jury trials and offers strategies for attorneys on how to reduce the impact of such biases in their cases, including in a virtual trial setting.Jury consultants and trial attorneys will share their insights and experiences on how implicit biases affect trial outcomes, how to identify the implicit biases that may impact the case, and how to manage their impact.State and federal judges will offer perspectives from the bench, including efforts to ameliorate implicit bias in the courtroom with jury instructions and judicial standards, the impact of the pandemic on jury trials, and how attorneys can work with the bench to reduce bias.Each session in this two-part series will cover different topics.
