Every healthcare coverage issue is dependent upon the type of coverage involved. Is the coverage a government health care program, such as Medicare or Medi-Cal? Is it an individual plan or an employer-sponsored health plan? If it is employer-sponsored, is it ERISA plan? Is the plan an insured or self-insured health plan? Is the plan regulated by the Department of Managed Health Care or the Department of Insurance?
Variations in healthcare coverage and the laws applicable to coverage differ dramatically from one type of coverage to the next. This presentation will discuss the regulatory framework for the different types of coverage and how the patchwork of federal and state laws govern such issues as mandated benefits, consumer protections, reporting and disclosure requirements, provider disputes, solvency standards, rights to continuation of coverage, and similar issues.
