Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires entities doing business in California to provide warnings to consumers about exposures to chemicals which have been identified by the state to cause cancer, birth defects, or other reproductive harm. In 2016, the California Office of Environmental Health Hazard Assessment (“OEHHA”) promulgated new consumer warning regulations which have taken effect on August 30, 2018 (see Section 25600 et seq of the California Code of Regulations.) This panel will discuss the latest evolutions of Proposition 65, including latest requirements and practical steps for compliance, risk assessment, and remediation, and potential future developments.
